10DLC Messaging Terms & Conditions (Required when sending SMS messages in the USA)
These Terms and Conditions govern your use of 10DLC (10-Digit Long Code) messaging services (“10DLC Services”) provided by Cloud Telecom Solutions. By using our 10DLC Services, you agree to comply with these terms, as well as any applicable carrier requirements and federal regulations.
1. Eligibility and Registration
1.1 You must be a registered business entity with a valid Tax ID and must register your brand and campaign(s) with The Campaign Registry (TCR) before using 10DLC services.
1.2 We reserve the right to suspend or terminate access to 10DLC Services for failure to comply with these requirements.
2. Compliance Requirements
2.1 You agree to comply with all applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and carrier-specific rules.
2.2 You must obtain proper consent (opt-in) from all message recipients. Opt-in consent must be documented and provided upon request.
2.3 You must honor all opt-out requests immediately by removing the number from your contact lists.
3. Content Restriction
3.1 You agree not to send any content that is unlawful, deceptive, harassing, defamatory, abusive, obscene, or otherwise objectionable.
3.2 Prohibited use cases include, but are not limited to:
- SHAFT (Sex, Hate, Alcohol, Firearms, Tobacco)
- High-risk financial services
- Third-party lead generation
- Affiliate marketing
- Debt collection messaging without clear disclosures
4. Registration Fees and Surcharges
4.1 You are responsible for all fees associated with TCR brand and campaign registration, including monthly campaign fees and carrier surcharges.
4.2 We reserve the right to adjust pricing based on changes in carrier rates or regulatory requirements.
5. Message Throughput and Deliverability
5.1 Message throughput (messages per second) is determined by your campaign type, use case, and carrier approval.
5.2 We do not guarantee 100% message deliverability. Carriers may filter or block messages at their discretion, especially for non-compliant content.
6. Data Protection and Privacy
6.1 You agree to handle all customer data in accordance with applicable privacy laws, including GDPR and CCPA if applicable.
6.2 We implement reasonable security measures but cannot guarantee complete protection against unauthorized access or breaches.
7. Termination and Suspension
7.1 We may suspend or terminate your access to 10DLC Services for any violation of these Terms, carrier requirements, or legal regulations.
7.2 No refunds will be provided for any registration or messaging fees in the event of termination due to non-compliance.
8. Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the 10DLC Services, including message delays, carrier filtering, or outages.
9. Modifications to Terms
We reserve the right to modify these Terms at any time. Continued use of the 10DLC Services after changes constitutes acceptance of the new terms.
